1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Talktome.bio ("Talktome", "we", "us", or "our") that governs your use of the website at talktome.bio and the related paid Q&A service (the "Service").
By creating an account, sending a paid question, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to receive payouts as a creator. By using the Service you represent that you meet these requirements and that you are not barred from using the Service under the laws of any applicable jurisdiction.
3. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity that happens under your account. Notify us immediately at support@talktome.bio if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or applicable law.
4. Creators, questions, and answers
A "Creator" is an account holder who publishes a public profile at talktome.bio/<slug> and sets a per-question price. An "Asker" is anyone who pays to send a question to a Creator.
- Creators set their own price per question and may change it at any time.
- Creators are not obligated to answer any specific question. Unanswered questions are refunded to the Asker within 30 days.
- Creators choose per answer whether it is public (displayed on their profile) or private (visible only to the Asker).
- Askers grant the Creator and Talktome a worldwide, royalty-free license to display and store their question for the purpose of operating the Service. If the Creator publishes a public answer, the underlying question may be displayed alongside it.
5. Fees and payments
The Service is free to sign up. Talktome charges a platform fee equal to 10% of each paid question that a Creator answers. The remaining 90% is paid out to the Creator, minus any fees charged by our payment processor.
- Prices are set by the Creator and displayed to the Asker before payment.
- Payments are processed by third-party payment processors. You agree to the payment processor's terms in addition to these Terms.
- Creators are responsible for reporting and paying any taxes on their earnings.
- Payouts are made in accordance with our then-current payout schedule and minimum thresholds, which we may update from time to time.
- If a question is not answered within 30 days, the Asker is refunded the full amount and no platform fee is charged.
6. Acceptable use
You may not use the Service to send, request, publish, or promote content or conduct that:
- Is illegal, fraudulent, defamatory, threatening, harassing, or hateful.
- Infringes anyone's intellectual property, privacy, or publicity rights.
- Sexually exploits or endangers minors.
- Contains malware, phishing links, or unsolicited advertising.
- Impersonates another person or misrepresents your affiliation with anyone.
- Solicits regulated services (financial, legal, or medical) in a way that would require a license you do not hold.
- Circumvents the Service's payment flow, security, or rate limits.
We may remove content and suspend or terminate accounts that violate these rules. We may also cooperate with law-enforcement inquiries where required.
7. Content responsibility
Creators are solely responsible for the answers they publish and for any advice they give. Talktome does not verify or endorse Creator content and is not liable for it. Askers rely on Creator answers at their own risk.
8. Intellectual property
You retain ownership of the content you submit. You grant Talktome a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate, provide, and promote the Service. This license ends when you delete the content, except to the extent it has already been shared with other users or is required to be retained for legal reasons.
The Talktome.bio name, logo, and site design are our intellectual property. You may not use them without our written permission.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, sections of these Terms that by their nature should survive (fees owed, indemnity, disclaimers, limitation of liability, dispute resolution) will survive.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that any specific Creator will answer any specific question.
11. Limitation of liability
To the maximum extent permitted by law, Talktome and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability to you for any claim arising out of or relating to the Service will not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim, or (b) US $100.
12. Indemnity
You agree to indemnify and hold harmless Talktome and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your content, your use of the Service, or your violation of these Terms or applicable law.
13. Changes to the Service and Terms
We may modify or discontinue any part of the Service at any time. We may also update these Terms; if we make material changes we will notify you by email or by prominent notice in the Service. Continued use of the Service after the effective date of an update means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Talktome is established, without regard to conflict-of-laws principles. You and Talktome agree to submit to the exclusive jurisdiction of the competent courts of that jurisdiction for any dispute that is not resolved informally, except that either party may seek injunctive relief in any court of competent jurisdiction.
